The Heritage Act 2018

Parliament passed the Heritage Bill 2017 on 12 September 2018, effectively giving Western Australia a new heritage Act (to be known as Heritage Act 2018).  Read Heritage Minister David Templeman’s media statement.

Key changes to the new Act include a streamlined process for entering a place in the State Register; more certainty for owners wishing to develop their heritage places; better protections for important heritage places; and increased transparency by publishing the Heritage Council's advice to the Minister for Heritage on the inclusion of a place in the State Register.

Before the new Act can be proclaimed, a series of regulations must be approved by the Governor to ensure the new Act will have its intended effects (these are referred to as Proclamation Regulations).

To assist with finalising the proclamation of the new Act, the Department of Planning, Lands and Heritage sought input on behalf of the Heritage Council of WA on the draft Proclamation Regulations and various supporting guidelines and publications. Submissions closed on 3 May 2019. The Department would like to acknowledge all the individuals, organisations and agencies that have helped to shape this important contemporary piece of legislation to date.

The Heritage of Western Australia Act 1990 will continue to guide the conservation of places which have significance to the cultural heritage of the State until the new Act is proclaimed.

Guidelines and publications

The Heritage Act 2018 (the Act) will be supported by a number of guidelines, policies and other material. Some of these are required by the new legislation, while others are intended to guide the Heritage Council and others in applying various provisions of the Act.

Guidelines for Local Heritage Surveys

Under the Act existing local government heritage inventories will become known as a ‘local heritage survey’ or LHS. The Act directs the Heritage Council to publish guidelines that cover key areas for the preparation and review of these surveys, and requires that local governments give due regard to the guidelines.

Draft Guidelines have been developed in consultation with local government, building on existing practice notes.

Guidelines for State Government

The Act directs the Heritage Council to provide guidance to State government agencies in relation to the preparation of a heritage inventory, and for integration of heritage management into the Strategic Asset Management Framework. The department will liaise with state government agencies to develop the draft Guidelines for State Government.

Nominations to join Heritage Council of Western Australia now closed

Through March and April, Heritage Minister David Templeman sought nominations from experienced and qualified individuals interested in becoming a member of the new Heritage Council of Western Australia. Nominations closed Friday 3 May 2019. All nominations will now be reviewed, and all applicants will be advised of the outcome as soon as possible thereafter.
